Welcome to EPIC AI (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website (https://epicaihub.io/) and our Agentic AI trading software (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms, our Privacy Policy, and our Disclaimer. If you do not agree with these Terms, you must not use the Services.
1. Eligibility
The Services are intended for use by institutional firms, professional trading groups, and accredited investors as defined by applicable laws in your jurisdiction (e.g., SEC regulations in the U.S.). By using the Services, you represent and warrant that:
  • You meet the eligibility requirements for an accredited investor or institutional entity.
  • You are at least 18 years of age.
  • You have the legal capacity to enter into these Terms.
2. Role of EPIC AI
EPIC AI is a technology provider offering software solutions to facilitate client-directed trading strategies. We do not act as a financial advisor, broker, dealer, or investment manager. We do not hold, manage, or assume custody of client funds. You retain full custodial responsibility for your assets and accounts at all times.
3. Client Responsibilities
As a user of the Services, you agree to:
  • Approve the trading plan and parameters used by the EPIC AI software.
  • Maintain custody and security of your funds and trading accounts.
  • Monitor the performance and risks associated with the software.
  • Comply with all applicable laws, regulations, and contractual obligations related to your trading activities.
Engagement with the Services is voluntary, and you may opt in or opt out at any time at your discretion.
4. License to Use the Services
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your internal trading activities, subject to these Terms. You may not:
  • Modify, reverse-engineer, or decompile the software.
  • Use the Services for any unlawful purpose or in violation of these Terms.
  • Share, distribute, or resell the Services without our prior written consent.
5. Intellectual Property
The Services, including the EPIC AI software, EPIC IDENT™ Order Flow, Agentic AI algorithms, and all related content (e.g., text, graphics, logos), are the intellectual property of EPIC AI and are protected by copyright, trademark, and other laws. You may not use our intellectual property without our express written permission, except as permitted under these Terms.
6. Risks and Disclaimers
Trading in financial markets involves significant risks, including the potential for substantial financial loss. The use of the EPIC AI software does not eliminate these risks and may introduce additional risks, such as software errors or algorithmic underperformance. For a full list of risks, please review our Disclaimer. Past performance is not indicative of future results, and we do not guarantee any specific outcomes from using the Services.
7. Third-Party Integrations
The Services may integrate with third-party platforms (e.g., AutoTrader systems, exchanges). We are not responsible for the performance, security, or reliability of these third-party services. You assume all risks associated with their use.
8. Fees and Payment
Access to certain features of the Services may require payment of fees, which will be outlined in a separate agreement. You agree to pay all applicable fees in a timely manner. We reserve the right to modify our fees with prior notice.
9. Termination
We may suspend or terminate your access to the Services at our discretion, with or without notice, if you violate these Terms or engage in conduct that we deem harmful to our interests. You may terminate your use of the Services at any time by discontinuing access. Upon termination, your license to use the Services will cease, but provisions of these Terms that by their nature should survive (e.g., intellectual property, limitation of liability) will remain in effect.
10. Limitation of Liability
To the fullest extent permitted by law, EPIC AI, its affiliates, officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Services, including but not limited to losses from trading activities, software failures, or unauthorized access. The Services are provided on an “as-is” and “as-available” basis, without warranties of any kind, express or implied.
11. Indemnification
You agree to indemnify and hold harmless EPIC AI, its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, or expenses (including legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
12. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of The Dominican Republic, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in The Dominican Republic. You waive any right to participate in a class action lawsuit or class-wide arbitration.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website with a new “Last Updated” date. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.
